Harvest Town Circle Ltd v Rutherford, The Times, 22 August 2001 (EAT).The Employment Appeal Tribunal gave guidance on the statistics to be put before tribunals in order to establish whether section 109 and section 156 of the Employment Rights Act 1996 (which denies employees over 65 the right to claim redundancy payments and compensation for unfair dismissal) were indirectly sexually discriminatory.

The reservation of the right to develop in the lease only related to land owned by the landlord.
