Hannigan v Hannigan, The Independent, 23 May (CA)The overriding objective of the new civil procedure rules (SI 1998/3132) was to enable the court to deal with cases justly.

Although the solicitor used an incorrect form and there were other mistakes with the proceedings, the court should have used its discretion not to strike out the claim because of technical irregularities.

Occupiers' liabilityJolley v Sutton London Borough Council, The Times, 24 May 2000 (FamD)The council was liable for personal injuries caused to children playing on a derelict boat which had been abandoned on council land.

It was reasonably foreseeable that children would play on it and be injured even if the children had meddled with the boat in an unusual way.
