It's not that practitioners RISK doing unpaid work - we already ARE doing unpaid work. I have a client who needs to bring an appeal but whose Legal Aid certificate would have to be amended before we are funded for any appeal. I have another client whose emergency Legal Aid is about to expire, we have a CMC next week and urgently need a direction to instruct surveyors, which is not provided for under the emergency certificate and which will exceed the costs on the certificate. We either have to do the work unfunded and pray that the LAA will deign to allow the costs (leaving us with the bill if they don't, and potentially exposing the clients to costs liability), or we don't do the work and risk being found negligent. NONE of this is our fault, or our clients'.
