‘Genuinely confidential’ material will be redacted through a judge’s ‘file modification order’, which she said would be agreed in a ‘relatively informal process’. However judges 'are going to take some persuading that a document read out in court should be subjected to a modification order'.

So not open, not transparent, what can be revealed is entirely at the whim and prejudice of the Judges, Commercial Court Judges are happy to say to a litigant in person that they are 'using rape as a bargaining tool' and then delete the comment from the transcript and threaten anyone who might record his vile misogyny, with contempt... , for example so judges can't be held accountable, they are equally happy to allow wealthy litigation lenders to hide documents which may demonstrate fraud, judges who are happy to be parachuted in at the eleventh hour and cancel an entire week of hearings just to come to the defence of their colleague's nephew... Come off it. This is a fudge, there's nothing honest, open or transparent about it as long as judges can continue to fudge, obfuscate and protect their chums.
