Is this not ultimately a consequence of a surprisingly liberal and very hand-wringingy decision by the Supreme Court that British troops undertaking military action in Iraq were bound by the Human Rights Act?

For all the benefits of the HRA, there is one ginormous downside, and that is the need for proportionality. Creates uncertainty so claims (or defences) without merit get to trial as it's nearly impossible to strike them out.
