And to think I used to like the Jackson Five. . although the Osmonds were probably better!! We now have a new verb "to Mitchell". A loose definition might be to turn back the clock to the days when the Courts of Chancery held sway and before their obsession with form and procedure was mitigated by the Courts of Equity which was more concerned with odd concepts such as "Justice". The cureent rulemakers have an idea as to what goes on in the Rolls Building, but have no idea as to what does - or more frequently does not - go on in the average County Court. The idea of being in breach of an Order made by the Court of it's own motion but not served until after the date for compliance is a nonsense. We must now treat every Order or Direction as an Unless Order. No doubt the pendulum will swing back the other way, but only after some serious injustices have occurred. Good luck to all practitioners in the meantime.
