I've got one claim that is valued at around £5-6,000. SO far costs are over £10,000 + CFA Uplift + Disbs. Reason? Inarticulate major premise of INsurer that the Claimant is over egging the pudding. The fee earner on the other side has it amongst 400 other files. It should have been settled 2 years ago for £5,000 but they insist on making the litigation personal by insisting the claimant is chancing his arm.
It takes two to tango.
Insurers are there own wost enemy. They feel too much power in being able to press the "settlement button" and either make or break a claimant's resolve.
I do agree though that the small claims limit should be lifted as it would mean cheaper premiums almost overnight for all motorists. I'd make it £25,000 with everything below going through a Government portal, a non fault compensation system, based on the NZ model with a compulsory requirement to apply there first as in Ireland.
Britain would then not be such a "Rip Off".
Whilst at it, pull all non A&E funding from the NHS.
The people of this Country need to get used to the idea of the free market. There's no such thing as a free lunch.
I was across the water last week, £1 per litre of fuel. It could be the same here if we didn't have so many freeloaders.
