In regards to the 10% it is not about not being able to attend, I have never faced that issue, it is more about the client being in a position capable of conducting the case themselves to the end of the whole proceedings.

Why I have never been refused is because my clients would contact all parties and the courts [inc. judge] with the intentions of applying for MKF, this is done in almost all my cases well in advance of any forthcoming court hearing, my CV and application is served to all parties, that way if any party has any concerns then they can be dealt with at the earliest opportunity rather than on the day of the court hearing, laying the foundations correctly makes for a smoother process and avoids chaos.

Your comment on the difficult points of law is a very real and valid point, it is also one major factor in the role of the MKF's we do not have the people behind us to research the points of law or assistants, clerks or other to seek to find the best possible solutions, personally, I always find it more easier , if I face such a scenario I seek guidance from either the Judge on the case or from many of the friendly counsel and solicitors I have met along the way, I would rather find the answers to the problems first without going in to a court room blind and unprepared, that in itself causes undue delays.

The insurance matter has been a major concern for me in recent times, when I assist with cases from a particular "Organisation" I do know they do have Indemnity insurance, that said it was very difficult to obtain it from the outset.

As part of the changes in the legislation in regards to MKF's one would like to see, I do feel that Insurance should be on the top of the list in the need to be debated more rigorously and should be a minimum requirement before any person could be granted MKF status, well, that is my opinion anyway.
