So what do you now do? Do you be a good boy, take dozens of witness statements, obtain experts' reports in various disciplines and then write your letter before action (I know, I know, they call it something different these days, just for the sake of being different). Lo and behold the neighbour committing the nuisance holds up his hands and agrees not to do it again. You then bill your client £20,000 plus £4,000 VAT plus £10,000 disbursements plus £2,000 VAT thereon = £36,000.

"But why did you not just write the letter Mr Crawford.?"

"Because we can no longer do that Mr Whinge we have to get all our tackle in order before we move. It the new way of doing civil litigation."

"But that means you run up a whole load of costs which were not necessary"

"Well how was I to know he would give in so easily?"

"You won't know and you won't bloody well find out without writing to him. Who makes these silly rules up anyway? Here's my cheque for £1,000 and you can whistle for the rest and I shall sue you if you try to get any more out of me for running up costs unnecessarily".
