@anon 12:57 - and what equitable solution would you suggest? Not permit claimants' to claim unless the NHS admits a mistake? Allow claimants' to make a claim but only directly to the NHSLA/MDU without legal representation? Maybe the government could ban lawyers from claiming legal fees altogether, making claimants' pay privately if they want to take a case out against the poor doctors?

It is quite simple: the NHS should provide proper and thorough training to ensure that negligence doesn't occur. If negligence does happen (and doctors are only human, regardless of if they have a God complex) ensure that their representatives look to deal with the claim quickly, efficiently and fairly.

Both the NHSLA and MDU are guilty of running an absolute shambles of a legal outfit and cost their clients' (and Johnny Taxpayer) significant amounts of money in fighting cases where they should admit; delaying dealing with matters and waiting until outside of the court door before settling cases which should have resolved pre-issue. They have a duty to protect the public purse, and by shifting the blame for their own shortcomings onto claimants only highlights how desperate their situation is.

Stop blaming the lawyers - we are only here to help the innocent victims of negligence.
