I'm not surprised the LS case failed. There was nothing persuasive in it. Nothing definite, just maybe flimflam that any flavour of MoJ would have to address on the fly anyway.

Nevertheless this scheme won't happen.
1/ The conservatives are unlikely to be part of the next government and Labour are committed to dropping it.
or
2/ Litigation. This tender process has a due diligence flaw so serious it can't be got round. They either admit defeat now or face class action litigation from firms and duty solicitors this summer.

I've been at this game for long enough to spot a winner when I see one. This duty contract scheme can't survive.

I suggest the Law Society prepare by adding a requirement of 3 years PQE as a criminal defence solicitor for Duty Solicitors to return the qualification to having the semblance of ability and expertise in the police stations, magistrates and youth courts, the public rightly expect.
