But isn't that our job Timothy? We consider our client's case, we put it to the other side and then we seek to negotiate a settlement while ultimately preparing for a hearing if negotiations break down?

Aren't we supposed to be advising our clients of the merits AND RISKS in their claim and suggesting courses of action that may result in a negotiated settlement? Have Tomlin Orders suddenly been banned?

I'm confused as to the necessity of an independent third party - other than a judge - to be involved where solicitors are already on board. Are we all now incapable of taking a considered and rational view in favour of being our clients' rabid attack dogs?
