Anon at 5.17 - the complaints aren't about the process of calculating costs - we are already obliged to do that as part of our client care duties. The complaints are about the extra work involved and the delay this process imposes on any litigation. As someone above has already said, how can making the lawyers do more work actually reduce the costs?

Generally, how can LJJ claim it is beginning to work well when he also suggests a tranche of cases be released from the requirement because the new system has created a backlog?

He can't win this argument because, try as he might, he can't prevent lawyers continuing to try to do the best they can for their clients. Agreeing the other side's costs budget is only possible if you are satisfied their budget is reasonable. Since anyone preparing a budget will be anxious to include everything which might reasonably come up, budgets will every often be eye watering.
