There is not much incentive for a Respondent to settle in Early Conciliation, and I am not finding many cases that do. The Respondent may as well wait and see whether the Claimant stumps up the £250 Claim Fee or just gives up at EC stage when the Respondent does not want to talk. If the Claimant puts their money where their mouth is then negotiations with ACAS can take place once the Claim has been presented anyway.
