Dear DDJ, I am not a PI practitioner any more and I am sure that there are good firms and bad firms as you suggest, but I disagree strongly with your comment that "there is no risk at all".

Firstly, there is always a risk and secondly, there are innumerable practical risks that have nothing to do with law.

For example, I have experienced the situation where a client with a "slam dunk" case disappeared and inexplicably stopped giving me instructions. Legally, I could have sued my client for my fees, but that is hardly justice, and is rarely practical or even economic.

The point is that legal risk is not the only risk you have to deal with in private practice, but my experience is that judges and especially those from the bar, do not appreciate this and so will often make unfair criticisms of solicitors with regard to costs.
