Those solicitors shot themselves in the foot by not recording a risk assessment. That is their loss and will impact on their bottom line at the end of the year.

But for a DJ or DDJ to say that cases should not have a success fee for "slam dunk" children's cases (or any other case) is inaccurate. What about Part 36 risk, what about losing applications where costs are awarded to defendants and, as suggested above, exaggeration by the LF.

It frustrates me that highly paid DJ's, DDJ's and politicians are dictating issues that they clearly do not grasp yet "we are all in this together" and we have to take cuts.
