..and it will only get worse. Most Judges simply do not know how to deal with LIPs. They are so keen to be seen as acting fairly that they completely forget that there is another party in this litigation who is paying for legal representation. I am one contested probate action in which an evil LIP managed to protract the proceedings by FOUR years. The Master assigned to the case was absolutely awful almost oblivious to case management. Come the day of the trial the LIP simply turned up and said he is withdrawing his claim and literally walked off leaving the estate with 150k legal bill. I have no sympathy- the system has created the monster that is LIPs and the monster will only continue to grow until a judge ,solicitor or barrister gets seriously injured or god forbid killed for before it is realised that the system is seriously broken.
