Anonymous22 December 2015 12:31 pm well done for speaking out, its not often that Defendant's see that side. Also, well done for assisting those who cannot afford/get legal representation, helping people is why I got in this profession (sic) in the first place.

This is by no means a comparison but Claimant's offer free advice all the time. Probably 50% of my enquiries are not going to progress but I offer advice in any event (from pursuing complaints to signposting to the necessary place).

From my experience, a recent Clinical Negligence claim (dental) settled for £3000 (2 defendants at £1k and £2K). The cost of investigating was approx. £6K. It took expert evidence, a protocol LOC and "pulling teeth" for them to realise that there was a case. I even requested that my expert prepare a slim report so that I could disclose pre action. The Claimant was unemployed so the majority was PSLA (save for fuel costs and the like). Now, put this case in the new SCT of £5,000. I would not have been able to do it on a CFA/DBA or private fee paying contract (25% of £3,000 = £750) and then ATE/VAT would cost as well as having 2 defendants (I have not mentioned the technicalities of the court process). This client would have got the denial by the D's and walked away. With a legal mind, the case was successful and I was able to resolve it without proceedings.
