The article quotes Briggs as saying that ‘judges may well need more training in the law’. Too true My Lord, but is it possible? In the last 30 years there has been a steady migration away from the idea of the generalist lawyer or the generalist judge. Nowadays judges have their tickets and stick to what they know. DJs, the only generalists left among the judiciary struggle to keep up with the law whilst managing heavy caseloads, both in hearings and on paper. They have to rely on advocates to keep them straight.
I would challenge anyone, however knowledgeable and with whatever sized brain to have the encyclopaedic knowledge of the law necessary to dispense justice in these proposed courts. Insurers will still retain lawyers who will put together convincing submissions and arguments. The judge will be at a clear disadvantage and, with pressure of work preventing any proper research, findings will go the way of the stronger party.
