So, the reality is that the compulsory PII has proven to be a huge disbenefit to the practitioner.
Without the PII there would be nothing of consquence about which to litigate.
In the commercial terms we are encouraged to regard as the be all and end all, there is no justification for insurance to be compulsory.
Insurance should be voluntary, and if offered should be properly charged to the client. The lack of such charging has always been a problem; the client received a massive benefit without it being charged.
