Anon 17.45 - sorry, to conclude - in my view the claim would fail in terms of recovering the 10% - if they rejected it they rejected it, they cannot unreject it. The only route would be to show that they would have achieved a better result because the likelihood is showing they would have achieved the 10% down the line would be cancelled out by costs issues.
