I thought an undertaking was a guarantee that a solicitor would do something in the future, such as paying off a mortgage. Here, what is being talked about is some sort of warranty, which to my mind is a different matter altogether. I'd really like to see this judgement, not least because I can't really see a judge in the UK apparently deciding a case, not on the merits, but on the basis of who is insured.
