I am amazed at the ignorance.

Success fees and ATE arose from the desire to remove legal aid but to ensure access to justice. That remains the case hence the successful cases have to pay for the unsuccessful ones. Common sense really.

As for Rayner's suggestion of using Registrars or even a GP to deal with causation - truly idiotic.

This topic has really raised the true problem. Not costs as the court can deal with that as try have in this case. The true problem is the ignorance of those that do not work in the sector but chatter on about it as if they were experts. It is akin to Daily Mail readers going on about Johnny Foreigner.

It is very sad really. It also makes me wonder whether or not the LSF were rigorous enough.
