If ever we get legal aid back we must protect the party without it. An unassisted successful party (unless covered by insurance which it was compulsory to have such as in employers' liability and RTA cases) should be entitled to recover the costs from the LAA or whatever it is then called regardless of means. This would be of particular importance in matrimonial work where giving legal aid to the wife but not the husband (usually that way round) was an instrument of legalised extortion.
