And, even if ET's have ordered the respondent to reimburse the fee, how will the MOJ know that they did, as approximately half of employers do not pay the award in full. Pay the claimants and it will be then up to the respondent to ask for the money from the claimant if the facts show that claimant has been double paid. However, in the beginning it was the MOJ who got the unlawful payment from the claimant, it is there where it should be returned. Anything else will mean that the administration of the repayments will be great, and the government will lose money because it has been over niggardly.
