If you went with 'when physically received' a defendant could very easily claim not to have received the documents, or to have received them after the deadline. I can imagine it might also have other issues. For instance, if a defendant is away so doesn't actually receive the documents until a week after they are put through his door by the post-person..


There is an added complication that a lot of legal firms have disclaimers which explicitly say they don't accept service via e-mail - I don't know whether anyone has challenged such a disclaimer, and if so, what the outcome was.
