I wouldn't be surprised if more than 50% of claims end up at court because insurers haven't responded to offers in time. And claimant lawyers will seize on that as the increased fees help them stay in business and if they don't well they're not promoting settlement for their client.

And I say that having had the experience of being seconded to a large RTA insurer from my then defendant firm.
