1. People won’t have to value claims as there will be a tariff system; the government wants to severely curtail judicial discretion (that is a bad thing because it undermines the Rule of Law and judicial independence).

2. The vast majority of claims which proceed to trial result in the claimant attending court and giving evidence. That said, how is a layman supposed to ensure that the claim is served correctly or, in the context of motor claims, understand tricky issues such as RTA or Article 75 indemnity? The layman will be at significant risk of falling foul of technical arguments unrelated to the claim’s merits. Is this fair?

3. The right of meaningful and fair access to appropriate compensation is under threat. See points 1 and 2 above.

Thankfully, this government is incapable of getting anything right so reform is far from certain.
