I am currently involved in action against an NHS Trust for a life changing injury suffered by my Mother, which could so easily have been avoided had the hospital followed the NICE guidelines. Even her current consultant told us that the facts were indisputable and advised us to claim. The hospital's own independent internal route cause analysis document also stated that the injury would have been avoided had the correct procedures been followed.

Yet every response we receive from the trust has denied causation on entirely spurious grounds.

The facts are clear, yet they are arguing that black is white. Our lawyers are taking a sensible approach but the legal costs that the Trust's insurers will inevitably end up paying are soaring.

If this is scenario is repeated across the clin neg spectrum, then no wonder the position is as bad as it appears.
