I think he has lost the plot here. the Gina Miller case arose because the court in the end decided that the commons had powers that it did not think it had. I for one still consider that the various judges did not give enough emphasis on the powers of the executive to wage war etc( which has far greater effects on peoples rights than withdrawal) but that is a different question. it was not an example of them sitting on their hands. the point about the EU is that it was superior to all our laws. the proposed arrangements can be altered if it is decided to do so including the various powers of judges. this looks a thingly disguised power grab and I don't like to say it but it appears that the Daily Mail may have had a point.
