It seems surprising that such a restrictive view was taken at first instance of the limitation date given the significance of the substantive issues. There have been several similar cases in the past relating to other professional regulators and on each occasion the litigant was permitted to proceed. As to the merits, that will have to wait. What is clear is that depriving a professional of his or her livelihood is a serious business and that if there is an arguable basis to contest such a decision then it should be considered on its merits, not barred on a technicality.
