Some interesting comments about the status of CNFs. The main problem is that there is no guidance or case law on most of the Portal including the status of CNFs. They are designed for simple non fault RTA claims and are usually compiled by junior staff in the immediate aftermath of an accident. You can hardly expect a Solicitor or senior fee earner to compile them when the whole Portal process allows fees of £500 which figure has never been increased. It is then galling to me to see Defendants in lengthy Defences going into minute detail over any minor discrepancy between the CNF and the Particulars of Claim/Witness statements. In my view the CNF should not have the status Defendants try to attach to it.
