So on the basis that someone will have to pay (or write off) the costs in excess of the cap, it seems that the effect will be either to introduce an officially sanctioned discount of the damages which, in clinical negligence claims against government bodies, are considered necessary to provide for the claimant's losses and needs or to require the legal profession to provide legal services as, in part, an act of charity.
