I can agree with his views of ATE and success fees. Always struck me as absurd that a losing Defendant should shoulder an additional liability. It meant they were always on the back foot from the outset. Provisional Assessments seem to have worked albeit that it takes the Court forever and a day to deal with and it appears that District Judges have lost the ability to hand write. Trying to fathom out the outcome is like reading old style doctor's medical records! A lot of the other reforms seem over technical and in the case of proportionality, incomprehensible. The cases I have which have required costs budgets have increased costs.
