I suspect this one will meander its way to The Supreme Court albeit the current position is probably correct. Importantly however conveyancers are going to have to wake up and smell the coffee. Large numbers still do not carry out electronic verification of ID documents; this should be mandatory and current practices of accepting TV licences and other inferior forms of ID should be deprecated. If you are acting for a seller you should be asking for Passsport, Driving licence and Utility bills. These must be electronically verified. This will not stamp out the problem completely but it will
assist.
