Anyone is capable of causing harm to others - I would argue that an injured individual could sue the state in the event that an agent of the court went rogue and harmed someone. As we all know, a practising certificate does not warrant sanity or safety to others. I would also argue it is tantamount to allowing certain individuals to skip airport security for example. Apologies, but I am risk averse, especially in circumstances where I would represent an individual harmed as a result of this decision. My view is that it would be actionable.
