The Darnley case is fact specific. If a prospective client walks into a solicitor's reception, then it could be over something distinctly non urgent, whereas with a hospital A & E department, the clue is in the title. Also, a solicitor is under no duty to take on every case. Indeed, there is a duty not to take on work that cannot be carried out properly.
