This demonisation of non disclosure clauses must stop. They are not instruments of oppression, but a perfectly sensible provision in many agreements. Just because someone makes an allegation of breach of contract or some other claim which may or may not involve an allegation of dishonesty or even criminal conduct, that does not make the allegation true. If the parties reach a financial settlement there does not have to be an admission on the part of the payer. They may all take a commercial decision to settle a claim that they consider to be unfounded. The alternative may be the pain and expense of defending the claims in public. Why should they then not require an provision in the settlement that the matter is kept confidential.
