Waving a smartphone around in the air and shouting blockchain, smart contracts, new technology and progress is the latest fad for the legal hierachy. There is no real attempt to consult or engage at all levels with the legal profession and the public to consider what options are available to design and create a legal system which is based on the whole management cycle of the legal processes so that the technology and courts cover all options. Nor is there any practical intention to deal with the issues that cause most people recurrent legal issues - such as costs incurred for termination of mobile phone contracts; disputes with landlords or employment claims. All the forms and advice now reside on gov.uk which is consistently inadequate in its scope and detail. A recent speech by a government adviser stated that the 5% without wifi and access to a computer were virtually so small a number as to be insignificant. That is the wrong approach and the new legal system should be based on making provision for all applicants. Any challenge to the proposals is now viewed as being against development. That is not the case; but the fact is at this time greater value is being given to the views of the software companies than those who have had experience of the legal systems or who provide advice.
