I am sure that Juries are acquitting 'guilty' defendants because there is at present no difference between the 2 main 'types' of rape.

They don't want to place the label of 'rapist' over the head of someone for the rest of their life, and see them serve say a 6 year jail sentence, for what could have been a series of confused misunderstandings when both participants have been 'in drink'.

The law should start recognising the difference between an alleged rape between 2 parties in a hitherto consensual relationship, and an alleged 'stranger' rape, and make the offence and penalties for the former less severe than the latter.


Juries would then IMHO be much more willing to convict.
