If you were ever misfortunate enough to find yourself (or a close family member) involved in a significant injury case, good luck to you relying on an insurer to "give you what you are entitled to". Because as you would, given your professed background, realise the insurers are not under any positive duty to ensure a third party claimant is 'fully' compensated, rather they will compensate at the lowest level they can, to limit their liability and protect the shareholder profits.
if there was such a duty, there would be little need for large areas of the professional negligence market (or insurance premiums)

Maybe the claimant lobby should, for PI areas which remain extant seek to pressure the Govt to require insurers to be under a positive duty to properly compensate claimants and ensure they receive what they are "entitled" to. That would negate the need for lawyers. and to encourage adherence to the new world, those Insurance firms which fail to properly compensate should face potential criminal sanctions.... i'd vote for that
