Happens all the time. If you miss the deadline and get unless ordered out of it.

But we're not talking about a defence here. He had a defence. It was put to a Court. We're talking about an appeal. That's a positive step in proceedings that requires Court time and resource. When someone has deliberately taken themselves outside the Court's jurisdiction. When they've basically said they won't accept the Court's decision and make sure that they don't face the music. I don't see why someone in that circumstance should get the benefit of an appeal if they won't accept the downside of a conviction.
