This is an interesting and thoughtful article, but i am uncertain about its overall argument?
Lord Sumption’s judicial musings about the role of civil legal aid struck me as typical of a certain rarified type of intellect. Undoubtedly erudite, but perhaps a little cold-blooded?
However this article seems to urge egalitarianism without a supporting structure, as though goodwill and charity alone will save the day.
It may that the obvious answer is to better calibrate both civil and criminal legal aid to need; but this seems to be a short-term palliative.
Perhaps the problem is the law itself? Does it need to be so complicated? We have multiple choice exams these days, why not apply the same reductive approach to legal disputes?
The alternatives to major systemic change are limited, and all amount to rationing.
