Has anyone considered the amount of time taken by the courts in dealing with procedural strike outs? The fundamental principle is that there must be an end to litigation and a fair disposal of cases brought before the courts. Of course people shouldn't leave it until the last minute but it's human nature. The current CPR regime is correct - stupid and unfair points on time should not be taken and if they are potentially penalised in costs.
