I have to say I do find this decision odd - it does seem to fly in the face of the idea of fixed costs. The insurers should have thought of it when they drafted the fixed costs rules for the MoJ. But here are the usual insurance simpletons shouting fraud and saying there's some big cases coming soon, oh yes, definitely, maybe next year, probably.... If this is "fraud" someone should tell the D who ran the argument, the original judge, and HHJ Wood. Or perhaps they aren't as clever as insurance troll.
