You don't appear to appreciate the meaning of a "success fee" and the fact that it is a payment to reflect the risk of significant time and costs being written off in the case of an unsuccessful claim. In some cases, thousands of pounds worth of work have had to be written off, and claims made to the ATE Insurers in respect of significant disbursements. A success fee therefore takes account of that risk. It's nothing to do with the greed of a Claimant Solicitor - if there were no success fee payable, I doubt a significant number of Claimant Solicitors would take on anything but the easiest and least complicated of claims. Unlike Insurers' panel Solicitors, we don't get paid whatever the outcome.
