One of the SFO's senior lawyers took part in a panel event at Linklaters a few months ago. She took very much the same view: almost aggressively annoyed that law firms dared to use LPP. It was not well received.

It doesn't help, of course, that thanks to Three Rivers (5) this jurisdiction has a completely different approach to LAP than other common law jurisdictions. This is also resulting in damage to our attractiveness as a seat of arbitration and - where clients have a potential claim and a choice of venue in litigation - it renders us less attractive compared to, say, New York.
