I note that the authors of the Solicitor’s Handbook 2008 say that the solution to compliance in respect of referral arrangements is to send out compliance packs (see [2008] Gazette, 20 November, 9).

Wrong. But the solution to non-compliance can, as they contend, be described in a single sentence - scrap the rule that allows solicitors to buy clients. The rule should never have been introduced in the first place. It is quite contrary to the character of any group of people that have the effrontery to call themselves professionals.

I have seen many cases of my clients being put under considerable pressure by estate agents to instruct some conveyancing factory because of the kick-back received in respect of the arrangement.

If the profession wishes to continue to see itself as a profession, I urge the all-powerful Law Society Council to reconsider this matter urgently. It should follow the requirements of the majority of the profession and get rid of this stain on the reputation of solicitors. Let’s try and maintain a little dignity in this crude, commercial world.
