Fees Hint
Personal injury lawyers and the insurance industry are eagerly awaiting the Court of Appeal's decision on the issue of recoverability of success fees and insurance premiums in the case of Callery v Gray.
A decision is expected shortly and is likely to have a profound impact upon personal injury litigation.Therefore, it was with some interest that I read a recent interview in The Times with the Master of the Rolls, Lord Phillips of Worth Matravers.Understandably, Lord Phillips was cautious on the issue of conditional fee agreements in light of the expected ruling.However, when pressed on the issue his Lordship was quoted as saying that he suspects 'the mark-up by solicitors on their fees may sometimes be too high'.Is this perhaps a hint as to which way the Court of Appeal may decide this important issue?
