Funding rethink

I write in response to Neil Donald's letter about the use of the CLSAPP7 form in cases where the client is a respondent in existing...I write in response to Neil Donald's letter about the use of the CLSAPP7 form in cases where the client is a respondent in existing proceedings (see [2001] Gazette, 22 March, 16).The form is necessary to verify the grounds on which the client seeks an exemption to the requirement to attend a meeting with a mediator.

It also confirms that the client has been advised of mediation as an option but has chosen not to pursue this course of action because one of the possible exemptions applies.

The Legal Services Commission is consulting on proposed amendments to the funding code and guidance, and in April we will issue a revised CLSAPP7 form.

We acknowledge Mr Donald's point about the requirement for both the client and the instructing solicitor to sign the form and we are considering removing this.
